Vakalatnama filed by Sri Dhananjay Singh Yadav, Advocate on behalf of respondent no. 5 is taken on record.
Heard learned counsel for the petitioners, learned AGA for the State, Sri Dhananjay Singh Yadav, learned counsel for respondent no.5 and perused the record.
Respondent No. 5 Bhabhuti Lal Verma is personally present before the Court and has produced the corpus Shashanki Verma @ Sobha, in compliance of order of this Court, who has been duly identified by Sri Dhananjay Singh Yadav, learned counsel for respondents No. 5.
Upon being enquired, the corpus Shashanki Verma @ Sobha states that she is intermediate pass and after that she has completed nursing course of three and half years and doing nursing job in District Hospital, Shahjahanpur. She further states her date of birth is 05.05.1994. Learned counsel for the petitioners submits that he is not disputing the date of birth and majority of the corpus. She further states that she knows Rishabh (petitioner no. 2) with whom she had performed marriage. She further states that she is not willing to go with Rishabh (petitioner no. 2), as he used to torture her and he had once administered poison to her. She further states that she wants to live with her parents.
In view of above, the corpus Shashanki Verma @ Sobha is major and she states that she had performed marriage with Rishabh (petitioner no. 2), but she is not willing to go with him, as he used to torture her and he had once administered poison to her and she wants to live with her parents. The petition is devoid of merit and is liable to be dismissed.
Accordingly, the petition is dismissed.
Copy of order be provided to learned counsel for respondent no. 5, within 24 hours.
