Heard learned counsel for the applicants and learned A.G.A. It is contended by learned counsel for the applicants that in respect of the incident which had occurred in he year 1992, its FIR has been lodged in the year 2008. The FIR is based on false and frivolous allegation but without doing the proper investigation the chargesheet has been submitted.
Learned A.G.A. prays for and is granted four weeks time to file counter affidavit.
Issue notice to O.P. No. 2 returnable within four weeks. Considering the submissions made by learned counsel for the applicants, it is directed that the proceedings of criminal case No. 1635 of 2009 under sections 420, 467, 468, 406, 471 IPC pending in the court of learned C.J.M. Pilibhit shall remain stayed till the next date of listing.
List after four weeks for orders.
