.…Petitioner … Respondent This Criminal Revision Petition is filed under Section 397 r/w 401 of Cr.P.C praying to set aside the judgment and order dated 16.10.2018, passed by the Hon’ble LVII City Civil and Sessions Judge, Bangalore, in Crl.A.No.25015/2015, which is produced herewith at Annexure-A and consequently enhance the interim maintenance granted to the petitioner from INR 7,000 to INR 1,00,000 and also grant INR 1,50,000 towards legal costs.
This Criminal Revision Petition coming on for Orders, this day the Court made the following:-
O R D E R The learned counsel for the petitioner has filed a memo to withdraw the petition. The said memo is signed by the petitioner along with the learned counsel for the petitioner. It is also accompanied with Certified Copy of the Memorandum of Agreement entered into between the parties under Section 89 of Code of Civil Procedure read with Rules 24 and 25 of the Karnataka Civil Procedure (Mediation) Rules, 2005.
2. In the memo it is stated that as per the Memorandum of Agreement entered into between the parties before the Mediation, a comprehensive settlement has been entered into between the parties and the respondent/husband has agreed to pay a total sum of Rs.75,00,000/- (Rupees Seventy Five Lakhs) towards alimony and maintenance and the petitioner has undertaken to withdraw all proceedings pending against the respondent husband and one such petition is before this Court.
3. In the light of the settlement entered into between the parties, the petitioner is withdrawing the petition, as the matter has been amicably settled.
4. The said memo and the Certified Copy of the Memorandum of Agreement are placed on record and the petition is dismissed as withdrawn.
