(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) We are informed by Mr Trivedi, learned advocate appearing for the petitioner that respondent No.14 is dead.
The learned advocate appearing on behalf of the private respondents is directed to file supplementary affidavit disclosing the date of filing of the applications for grant of sanctioned plan before the Municipal authority. Let such affidavit be given within ten days from today.
The Municipal authority is also directed to file supplementary affidavit disclosing the date of filing of such applications for sanction by all the private respondents and will also indicate whether such applications have been disposed of within 90 days from the date of filing of such applications. It will also disclose whether after disposal of such applications, the Municipal authority has communicated the decision of the Municipality regarding fate of the applications for sanctioned plan to concerned respondents and the mode of service of such communication upon those respondents. Let such affidavit be also given within ten days from today.
Until further order, no construction should be made unless construction is strictly in accordance with the rules, regulations and bye-laws of the concerned Municipality.
Reply, if any, to the supplementary affidavit/s should be filed within a week thereafter.
Let the matter appear on April 19, 2012.
