1. This petition seeks issuance of a writ in the nature of mandamus directing respondents not to demolish the residential houses of the petitioners without adopting due process of law.

2. We find from the pleadings and it is admitted by learned counsel for the petitioners that civil suit has already been filed in regard to the property at issue. The State of U.P. and Tehsildar have been arrayed as parties.

3. In peculiar facts and circumstances of the case, we find that the writ would not be the remedy available to the petitioners.

4. The petition is dismissed.
