2. Present civil application has been filed for fixing an early date of final hearing of main appeal in the facts and circumstances inter alia that the appellant is aged about 95 years.

3. In the facts and circumstances and considering the controversy involved, the prayer in terms of paragraph 3(B) is granted. The main First Appeal No.1551 of 2005 is ordered to be placed on board for final hearing on 05.03.2012. Rule is made absolute accordingly.
