Heard learned counsel for the petitioner and the learned Additional Government Advocate.
Under challenge in the instant writ petition is FIR relating to Case Crime No.210 of 2010 under Sections 498-A, 323, 504, 506 IPC and 3/4 of Dowry Prohibition Act, Police Station Ghazipur, District Lucknow.
We have gone through the contents of FIR and the other documents annexed thereto.
It seems that the dispute between the petitioner no.4 namely Vishal Sonkar and respondent no.3 Smt. Shaloo Sonkar (complainant) who are husband and wife, erupted due to some misunderstanding between them to which parties have tried to reconcile the matter between them and as such on two occasions, the parties had tried to settle the dispute which resulted in a nullity. It also comes out that the petitioner no.4 has filed an application under Section 9 of Hindu Marriage Act against respondent no.3 which is also pending.
Issue notice to the respondent no.3 returnable at an early date. Let counter affidavit be filed by respective opposite parties within a period of six weeks. Rejoinder affidavit, if any, be filed within two weeks. List after expiry of the aforesaid period.
Till the next date of listing, it is provided that the petitioners shall not be arrested in the aforesaid case crime number. However, the investigation shall go on and the petitioners shall cooperate with the same.
