Following prayer has been made in the writ petition:-
"Issue a writ of mandamus directing the respondents to release the payment of arrear of salary to the petitioner since 1.7.2015 to 17.1.2016 including interest as per rule 29 of the U.P. Basic Education Service Rules, 1981 framed under the Act within stipulate period fix by this Hon'ble Court."
It is alleged that though petitioner has worked for the aforesaid period, but salary has been denied to her. Despite various representations made, no decision has been taken by the authority concerned, hence, petitioner is before this Court.
Sri S. K. Srivastava, learned counsel for the District Basic Education Officer concerned submits that petitioner's grievance shall be examined by the authority competent, in accordance with law, at the first instance.
In the facts and circumstances, this writ petition stands disposed of with a direction upon the respondent no.5 to accord consideration to petitioner's claim, noticed above, and appropriate order would be passed in light of applicable govt. orders as well as in accordance with law, within a period of three months from the date of presentation of certified copy of this order.
