Heard Sri Abhishek Kumar Srivastava, learned counsel for the petitioner, learned Standing Counsel for respondent no.1 and Sri Vivek Kumar Rai, learned counsel for respondent nos.2, 3 and 4.
The petitioner in the writ petition is seeking a direction to the respondents to pay the amount of Rs.3,87,632/- stated to have been illegally deducted from the gratuity amount of her husband late Kashi Nath Dubey, who was working as Junior Engineer in the U.P. Jal Nigam, Allahabad.
According to the petitioner, a sum of Rs.10 lacs was to be paid to her out of which Rs.6,12,367/- has been paid and Rs.3,87,632/- has been withheld stated to be against the other recoveries. What are the other recoveries have not been disclosed in the order annexed as Annexure-3 to the writ petition.
No useful purpose would be served by keeping the matter pending.
The writ petition is, accordingly, disposed of with a direction to the Chief Engineer Allahabad Region, U.P. Jal Nigam, Allahabad to consider the claim of the petitioner and take a decision in the matter expeditiously, preferably within a period of two months from the date of receipt of a certified copy of this order.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
