Instructions as have been received by the learned Standing Counsel state that certain action has been taken under Section 107/116 Cr.P.C.
If the petitioner's contention, which is available in the application which he had filed at page 24 of the writ petition, is that the property was in a dilapidated state then the application of the petitioner should be now treated as an application for taking action under Section 133 Cr.P.C.
The writ petition is disposed of.
