Heard learned counsel for the petitioner and learned Standing Counsel appearing on behalf of State-respondent.
By means of this petition under Article 227 of the Constitution of India, petitioner is seeking a direction to the court below to decide the application 7-C moved by the plaintiff-petitioner under Order 39 Rule 1 & 2 C.P.C. as well as original suit no. 575 of 2014 (Smt. Sharda Devi Vs. Bhola and another) and the temporary injunction application, in a time bound manner.
Considering the facts and circumstances of the case this application is therefore disposed of with a direction to Additional Civil Judge (J.D.), Court No.3, Gorakhpur to decide the aforesaid application, expeditiously, preferably within a period of six months from the date a certified copy of this order is produced before it.
