Heard learned counsel for the petitioner and learned Standing Counsel for the State.
By means of this writ petition, the petitioner has come to this Court with a grievance that his bid being lowest he has not been granted contract.
The petitioner had participated pursuant to the tender notice published on 16.10.2018. At the time of filing e-tender, the petitioner had all the requisite documents including the solvency certificate. The date of opening of bid was thereafter postponed from 3.11.2018 to 12.11.2018. When the bid was open on 12.11.2018, it was found that the petitioner's solvency certified had expired, therefore, the petitioner's bid was not considered.
Learned counsel for the petitioner submits that had the tender open on the earlier fixed date, he had a valid solvency certificate and being the lowest bidder, he would have got the contract.
We have considered the submissions made by learned counsel for the petitioner and the learned Standing Counsel.
On the date of opening of bid, the solvency certificate issued in 2016 i.e. two years ago expired and, therefore, the petitioner was without solvency certificate, as such no error can be found at the hands of the authorities not to consider the bid of the petitioner.
The writ petition lacks merit and it is , accordingly, dismissed.
