JUDGMENT / ORDER

ANTONY DOMINIC, J. The petitioner, a male nurse employed in Kuwait, has filed this Writ Petition alleging that he and Twinkle Paul, whose father is the 3rd respondent, were working together in Lotus Children's Hospital, Hyderabad and that during the said period, fell in love. According to him, they were constantly in touch and they decided to get married and live together thereafter. However, it is also stated that the same is not approved by her parents and as a result, now the detenue is being illegally detained by her father, the 3rd respondent. It is with this allegation, producing two photographs and certain documents evidencing their communication, the Writ Petition was filed for issue of a writ of habeas corpus.
2. On the filing of the Writ Petition, this Court passed an order dated 6.6.2014 directing the 2nd respondent to conduct a discreet enquiry into the matter and also to get the statement of the detenue recorded by a women constable. When the case was taken up today, the learned Government Pleader made available to us the - : 2 :-
report of the 2nd respondent and also the statement of the detenue recorded by Smt.C.S.Sujatha, Women Police, Sub Inspector, Aluva, on 7.6.2014. In her statement, the detenue has stated that she and the petitioner had worked together in a hospital at Hyderabad and that she had an acquittance. However, she has stated that when the petitioner showed interest in getting married her, having regard to the fact that both belong to different community, she rejected that offer. It is also stated that the petitioner and his relatives came to her home on 1.6.2014 to propose marriage with her and that the same was rejected by her parents. She further stated that she is residing with parents now and is undergoing M.Sc. course in a college at Chalakkudy. In the above circumstances, we are satisfied that the petitioner has not succeeded in establishing a case of illegal detention of the detenue by her father. We, therefore, decline to entertain this Writ Petition. Accordingly the same is closed.
