Heard learned counsel for the revisionist, learned A.G.A for the State and Shri Krishna Gopal, learned counsel for the opposite party no.2.
Notice on behalf of the opposite party no.1 has been accepted by the learned A.G.A.
Learned counsel for the opposite party no.2 prays for and is granted four weeks' time to file counter affidavit.
List thereafter.
The impugned judgement and order dated 21.8.2018 passed by the Principal Judge, Family Court, Bareilly/Fast Track Court no.1 Bareilly in criminal Misc. Case No. 208 of 2011(Smt. Urmilesh Vs. Sharat Chandra Sharma) shall remain stayed subject to the condition that revisionist shall keep on paying Rs.5,000/- per month to the opposite party no.2 and 5,000/- to her minor daughter.Revisionist shall deposit 50% of the arrears of maintenance within a period of three months from today.
It is made clear that in case of non compliance of this order, the interim order granted to the revisionist shall automatically stand vacated.
