Case called out. None appears for the petitioners. Counter affidavit has been filed by the State which is taken on record.
In the counter affidavit, it has been stated that petitioner no. 2 Sadaqat was arrested on 27.05.2010 in connection with case crime no. 357 of 2010 under Section 457 & 380 IPC of police station Kasimpur, district Hardoi. He was produced before the learned Magistrate concerned within twenty four hours on 28.05.2010 who after going through the case diary remanded him to judicial custody and he was sent to jail.
It has further been stated in the counter affidavit that petitioner no. 1 Sharafat was never arrested by the police personnel rather he was called at the police station on 26.05.2010 for the purpose of inquiry in case crime no. 357 of 2010 under Section 457 & 380 IPC of police station Kasimpur, district Hardoi and after making inquiry he was allowed to go back after making due entry at Rapat No. 21 of 12.10 pm dated 26.05.2010.
However, since learned counsel for the petitioners is not present, list the case again in the cause list in the month of July 2010.
