By this appeal, a challenge is made to the order dated 11.05.2018 passed by learned Additional Session Judge, Court No. 2, Muzaffar Nagar in Bail Application No. 900 of 2018 arising out of Case Crime No. 716 of 2017 under Sections 302, 201, 376D, 34 IPC and 3(2)5 and 3(1)B(1) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, Police Station Charthawal, District Muzaffar Nagar by which the bail application preferred by the appellant was dismissed.
The first information report was lodged against unknown person but during the course of investigation, evidence against the appellant was collected to bring chain of circumstances apart from his confessional statement.
I am not discussing the statements of the witnesses recorded during the course of investigation as it may affect either of the parties in the trial. It is a case of double murder and taking into consideration overall facts, I do not find any ground to cause interference in the order dated 11.05.2018 dismissing the bail application.
In view of the above, the appeal is dismissed.
It is made clear that any observation made in this order would not affect the trial. The trial Court is directed to expedite the proceedings.
