This criminal petition is filed under Section 439 of Cr.P.C praying to enlarge the petitioner on bail in Cr.No.07/2017 of Bellanduru Police Station, Bengaluru, for the offence P/U/S 150, 365, 302 and 201 r/w 34 of IPC.
This Criminal Petition coming on for Orders this day, the Court made the following:
O R D E R Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent-State.
2. The petitioner (A4) along with four others, is chargesheeted by the respondent-police in respect of the offences punishable under Sections 302. 365, 150, 201 r/w Section 34 of IPC.
3. The petitioner (A4) is the mother of accused No.1 and the mother-in-law of deceased Prakash.
4. The allegation is, the first and second accused had illicit relationship with each other and conspired to finish off the deceased, the husband of 1st accused. Accused No.3 paid advance amount of Rs.10,000/- to accused No.2. Accordingly, accused Nos.2 and 3 waylaid the deceased on the night of 12.09.2016, abducted him, murdered him and left the dead body in the house of this petitioner.
5. Accused No.2 is enlarged on bail by the orders of this Court in Crl.P.No.4461/2017. No incriminating materials connecting this petitioner to the alleged incident is seen from the chargesheet material.
In the given circumstances there is no impediment to allow the petition. Accordingly, the petition is allowed. Petitioner is enlarged on bail in Cr.No.7/2017 registered by the respondent-police, subject to the following conditions:
(i) She shall execute a self bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the concerned Court.
(ii) She shall attend the Court regularly on all hearing dates; and (iii) She shall not threaten or prevail upon the prosecution witnesses.
