Heard learned counsel for the petitioner-appellant and learned Standing Counsel for the State-respondents.
The writ petition of the petitioner-appellant has been dismissed by the impugned order dated 17.01.2019.
The petitioner-appellant appears to have filed the writ petition for a direction to extend his services in pursuance of the Government Order dated 17.10.2018 and for the payment of honorarium for the period 01.07.2017 to 31.12.2017. The writ petition has been dismissed on the ground that there is no material on record to establish that the petitioner had worked till 20.10.2016.
Be as it may be, as regards the contention of the petitioner-appellant that his services are liable to be extended in view of the Government Order and that he has not been paid honorarium for the aforesaid period, we are of the opinion that the matter requires consideration by the District Magistrate, Etawah-respondent no.3.
In view of the above, we dispose of the present special appeal with liberty to the petitioner to make a representation of his grievance before the District Magistrate, Etawah within a period of two weeks from today whereupon, he will consider the same in accordance with law and pass a speaking order with regard to the extension of service of the petitioner- appellant and entitlement of honorarium for the period referred to above.
