1. Heard Mr. Joshi, learned Advocate for petitioner. It is submitted that present petition is identical to other petitions i.e. Special Civil Applications Nos. 1244 of 2012, 1277 of 2012, 1278 of 2012 and 1324 of 2012. He also submitted that in present case also recovery has been effected. Mr. Joshi has also relied on the order dated 31.01.2012 passed in aforesaid group of petitions and has prayed that since present petition is identical, similar order may be passed.
2. Having regard to the submissions made by learned counsel for the petitioner and the judgment dated 26.08.2009 passed in group of petition being Special Civil Application Nos.2668 of 2009, 2669 of 2009, 2681 of 2009, 28547 of 2007, 28549 of 2007 and 28571 of 2007, let Notice be issued returnable on 25th June 2012. The recovery, if any, made by the respondent, shall be subject to the result of present petition.
