Heard learned counsel for the petitioner-appellant and learned Standing Counsel.
The request of the petitioner-appellant for compassionate appointment on the death of his father was turned down. The writ petition has also been dismissed with the observation that the petitioner-appellant was involved in the criminal case under Section 302 I.P.C.
In view of the above involvement of the petitioner- appellant in the criminal case, learned Single Judge refused to exercise the discretionary jurisdiction. The refusal to exercise discretionary jurisdiction in such a situation cannot be faulted with.
Accordingly, we are of the opinion that the special appeal has no merit and is dismissed.
