Heard learned counsel for the petitioner and perused the record.
Present petition has been filed with a prayer that the Court below i.e. Additional Civil Judge, Senior Division III, Varanasi to consider and decide the application filed by the petitioner under Sections 27 and 28 of the Uttar Pradesh Urban Building (Regulation of Letting, Rent and Eviction) Act, 1972 in P.A. Case No. 14 of 2017 (Sharad Kumar Jaiswal vs. Gunjan Kumar Barnwal & another) expeditiously within a specified time.
In the facts and circumstances of the case, the present petition is finally disposed of with the direction to the Additional Civil Judge, Senior Division III, Varanasi to expedite the hearing of the aforesaid application and decide the same on its own merit, in accordance with law, expeditiously, preferably within a period of three months by giving short dates provided there is no legal impediment and no unnecessary adjournments shall be granted to the parties.
With the aforesaid observations/ directions, the present petition is finally disposed of.
