Heard learned counsel for the petitioner and the learned Standing counsel.
The petitioner has filed this writ petition for a direction upon Executive Officer, Nagar Palika Parishad Orai, District Jalaun to take action for removal of the waste from the land of the petitioner gata no. 314, Mauza Umrar Gramin, Pargana Orai, District Jalaun.
The petitioner contends that some private persons had put the waste material on the land of the petitioner by removing it from the puccka road situate adjacent to it.
In view of the above, the grievance of the petitioner is basically against the private persons who have unauthorizedly put the waste material on the land of the petitioner. The Executive Officer, Nagar Palika Parishad is not concerned with it. The petitioner may either get the aforesaid waste material removed at his own cost or may sue the private persons who are responsible for putting the said waste material on his land.
In view of the above, no direction is necessary against the Executive Officer, Nagar Palika Parishad.
The writ petition accordingly lacks merit and is dismissed.
