Heard learned counsel for the applicant, learned A.G.A., and Sri Anil Srivastava, learned counsel for the complainant. Perused the record.
This bail application has been moved by the applicant Shanu who is involved in Case Crime No. 1223 of 2016, under Sections 326, 302, 498-A, 506 I.P.C., Police Station-Tajganj, District-Agra.
As per prosecution version, on 13.11.2016, applicant poured kerosene oil on his wife and set her on fire due to which she died in hospital.
Learned counsel for the applicant contends that he has been falsely implicated in this case and his wife has committed suicide. He further contends that date or year of marriage has not been mentioned in the FIR.
Learned A.G.A., and learned counsel for the complainant have opposed the prayer for bail and contend that in the dying declaration, deceased has specifically stated that the present applicant has poured kerosene oil and set her on fire.
Considering the fact that there is superficial to deep burn injury over the body except lower abdomen, I do not find it a fit case for enlarging the applicant on bail.
Application stands dismissed.
