Shanu @ Anu vs State Ofkerala

High Court Of Kerala|13 October, 2014

JUDGMENT / ORDER

The petitioner herein is the first accused in C.C 181/2011 before the Judicial First Class Magistrate Court, Kattakada. He seeks a direction to the learned Magistrate for speedy disposal of the case on the ground that he has obtained some employment abroad, and that if he could not join the employment within a short period, he would lose it. I find that the request will have to be considered by the learned Magistrate. The petitioner can very well approach the learned Magistrate with the request, and if he has necessary material to show that he has obtained some job abroad, the request will have to be positively considered by the learned Magistrate. I do not think that request made with necessary materials, for speedy disposal out of turn will be declined by the learned Magistrate. In the result, this OP(Crl.) is closed, with direction to the learned Magistrate that in case request is made for speedy disposal of C.C 181/11 with necessary materials showing the grievance or urgency, the same shall be judiciously considered and decided by the learned Magistrate.
