JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Rule.
Mr.Pandya, learned APP waives notice of Rule.
The present application has been preferred by the applicant-convict for temporary bail on the ground that he wants to close the bank account and transfer it in the name of his mother.
It appears from the jail report that the convict has been recently released on furlough on 06.11.2011 to 19.11.2011 and the communication of the bank is of September 2011.
Under the circumstances, during the said period, the aforesaid work could have been completed. In any case, the transfer of the Bank account can be done by the convict by addressing correspondence and after verifying his signature through the jail authority.
Hence, at this stage, he would not be released on temporary bail. But at the same time, appropriate direction deserves to be issued to the jail authority for forwarding of the papers to the concerned bank duly signed by the applicant-convict.
Under the circumstances, the application is disposed of with the direction that the convict shall be at the liberty to address appropriate correspondence to the bank for closure and/or transfer of the account in the name of his mother and the jail authority shall forward those papers to the concerned Bank after verifying the signature of the convict for such purpose.
Subject to the aforesaid direction, the application is disposed of accordingly. Rule discharged.
