JUDGMENT / ORDER

1. Rule.
Learned APP, waives service of rule on behalf of resp

The applicant, a life convict, pursuant to the judgment dated 18.7.2011 passed in Sessions Case No. 1064 of 2011 seeks three weeks of temporary bail to complete construction of residential premises on the plot allotted to her mother by Taluka Development Officer and in support of his case the order of allotment of plot by Taluka Development Officer, Kankrej, District: Banaskantha, is annexed with the application.
3. Earlier the applicant was released on temporary bail for the same purpose but could not complete construction and now in view of ensuing monsoon it is imperative that the house is fully constructed.
4. Considering overall aspects, at this stage, a case is made out to grant three weeks of temporary bail to the applicant on furnishing a bond of Rs. 5,000/- (Rupees Five Thousand only) to the satisfaction of the jail authority and during his temporary bail, the applicant shall mark his presence once in a week before nearest police station. Accordingly, the applicant is hereby ordered to be released on temporary bail for the period of three weeks. On completion of the temporary bail, the applicant shall surrender before the jail authorities in time.
5. Rule is made absolute.
