(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way of this application, the applicant-convict has prayed that he be enlarged on temporary bail for construction of his house.
Pursuant to the earlier order passed by this Court, learned APP, Shri Pandya, based on the report, which he has received from Police Sub-Inspector, Sihori Police Station has submitted that the ground mentioned in the application is genuine.
From jail remarks, we find that on earlier occasion whenever the applicant-convict has enjoyed furlough leave, he has surrendered to the jail authority in time.
Considering the totality of the facts, it is ordered that the applicant-convict shall be enlarged on temporary bail for a period of 2 weeks from the date of his actual release on personal bond of Rs.5,000/- with one surety of the like amount and with the further direction that the applicant shall surrender to the jail authority on expiry of the period granted by this Court.
Application is allowed to the aforesaid extent. Rule made absolute.
