This petition for writ is preferred to have an appropriate writ, order or direction for respondents to get the plots no. GU001 to GU008 levelled by filling-up soil in the pits existing over the plots. As per the facts averred in the petition for writ, the plots aforesaid were allotted to the petitioners in the year 2013. On these plots as per the petitioners, huge pits were available and those have been filled-up by the garbage. The grievance of the petitioners is that the pits should have been filled-up by the soil and not by the garbage. Before approaching this Court, petitioners submitted a representation to the respondents on 26th May, 2015.
As per learned counsel, a reminder was given on 20th August, 2018 but no action thereon is yet taken.
Having considered the facts of the case, we are of considered opinion that the appropriate remedy available to the petitioner is either before the Consumer Forum or before the Real Estate Regulatory Authority, as such, we are not inclined to interfere in the matter in writ jurisdiction. However, it is open for the respondents to consider and decide the representation submitted by the petitioners expeditiously.
The writ petition is dismissed.
