Heard Mr. Sunil Kumar Dubey, learned counsel for the applicants and the learned A.G.A. for the State.
At the very outset, learned counsel for the applicants submits though the dispute involved in the present application is a matrimonial dispute, but for some compelling reason, the husband was not impleaded as an applicant. He, therefore, submits that the present application may be dismissed as not pressed with liberty to file a fresh.
Prayer made is allowed.
The application is, accordingly, dismissed as not pressed with liberty to file a fresh, impleading the husband as an applicant, so that the matter may be referred to the Mediation and Conciliation Centre, High Court, Allahabad, as per the judgement of the Apex Court in the case of Rajesh Sharma and Others Vs. State of U.P. and another, reported in 2017 AIR (SC) 3869.
Certified copy of the impugned order may be returned to the learned counsel for the applicants after obtaining photo copy of the same to be kept on record.
