Petitioner challenges the notices issued under Section 13 Sub Clause 4 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. Against the order impugned the petitioner has statutory alternative remedy under Section 17 of the Act. He may seek his remedy accordingly.
In respect of the second relief it may be noticed that the petitioner had approached this Court earlier by means of writ petition no. 16449 of 2010 seeking a mandamus for consideration of his representation dated 03.02.2010 the writ petition was decided under order dated 01.04.2010 requiring the authority concerned to take decision the representation of the earliest. The representation was made for release of the margin money. The representation has been rejected by the Director Khadi Gram Udyog Government of India vide order dated 27/28.04.2010 after recording a finding that the petitioner's unit was not entitled for grant of margin money as on the date of inspection of the petitioner's unit it was found that a child labour alone was working and that the plant and machinery installed was old.
We find no good ground to interfere with the decision so taken by the authorities in facts of the case in refusing the margin money of the petitioner.
The writ petition is dismissed.
