Heard learned counsel for petitioner and perused the record.
The present petition has been filed by petitioners seeking direction to court below to decide the Suit No.1075 of 2015 (Smt. Shanti Singh and others Vs. Smt. Sunita Yadav and others) filed under Section 38 Specific Relief Act read with Section 9 C.P.C. pending in the court of Civil Judge (J.D.), Gorakhpur, within a stipulated period.
It is submitted by learned counsel for petitioners that suit filed by petitioners is pending since 2015 and on account of delaying tactics adopted by opposite parties the case could not be proceeded.
Considering the facts and circumstances of the case and without commenting on the merits of the case, learned Civil Judge (J.D.), Gorakhpur, is directed to decide Suit No.1075 of 2015 (Smt. Shanti Singh and others Vs. Smt. Sunita Yadav and others) filed under Section 38 Specific Relief Act read with Section 9 C.P.C., preferably within a period of one year from the date of production of certified copy of this order, unless there is any legal impediment.
With the aforesaid directions, the petition is disposed of.
