Order on Crl. Misc. Recall Application No. 2 of 2018
The explanation which has been given by the official concerned Sri Rakesh Kumar Singh in compliance of order dated 15.11.2018 is wholly unsatisfactory and not acceptable at all. The same is hereby rejected. However, the official concerned has apologized for the same and also submitted a fresh explanation today with an unconditional apology which has been placed on record by the Registrar General.
In view of the above, the said unconditional apology is accepted with caution to the official concerned Sri Rakesh Kumar Singh that he would be careful in future and would not repeat the same failing which, the Court would be compelled to take strict action against him.
Heard Sri Sanjay Dwivedi, learned counsel for the petitioners, Sri Rajiv Kumar Pandey holding brief of Sri Sanjiv Kumar Pandey, learned counsel for opposite party no.4, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
Considering the facts and circumstances of the case, as the investigation is stated to be pending till date and this Court has stayed the arrest of the petitioner in the aforsesaid case vide order dated 24.08.2018, the Investigating Officer of the present case is directed to conclude the investigation of the present case and submit a police report before the Magistrate concerned within a period of six weeks from the date of production of certified copy of this order in accordance with law.
The S.P. Mirzapur shall ensure compliance of the present order within the aforesaid period.
With the aforesaid order, the present recall application stands disposed of.
