None is present on behalf of the appellant to press this appeal Present appeal has been filed under section 378 Cr.P.C. against the judgement and order dated 18.2.1982 passed by Judicial Magistrate, Mohammadabad, District Azamgarh acquitting the accused-respondents of all the charges.
The C.J.M., Azamhgarh, vide letter dated 18.6.2016 has informed that appellant, Smt. Shanti Devi has already expired and in this respect the statement of the husband of the appellant has been recorded. The C.J.M. Azamgarh has also reported that the accused-respondent, no. 1, Gorakh Nath Singh has also expired.
Since the appellant has already expired and legal heir has not come up to press this appeal, the appeal is accordingly dismissed having been abated.
