Shri Amar Nath Pandey, learned counsel for the petitioner submits that the petitioner, who is Senior citizen, is facing Original Suit No.475 of 2014 (Girja Shankar vs. Shanti Devi), as a defendant since 2014.
Learned counsel for the petitioner submits that despite more than four years have been elapsed, till date, no issues have been framed. He further submits that the petitioners are always co- operating with the proceedings of the suit, however, the matter has been adjourned due to one pretext or other. In order to substantiate his submissions, he has drawn the attention of the Court towards the order sheet, annexed as annexure No.3 to the petition.
Considering the submissions and petitioner being a senior citizen, this petition is disposed of in the light of the judment passed by the Hon'ble Supreme Court in the matter of M/s Shiv Cotex vs. Tirgun Auto Plast P. Ltd and Others 2011 (89) ALR, 232 with the direction to learned trial court to take all possible endeavour to decide the suit, expeditiously preferably within a period of one and half year from the date of production of a certified copy of this order, without granting any unnecessary adjournment to either of the parties.
The parties will also co-operate to expedite the process of final disposal of the suit.
