Heard learned counsel for the petitioner and Ms. Pooja Agarwal, learned counsel for the respondent no.4.
The petitioner is before this Court for a direction to respondent no.1/Judge, Small Causes Court, Allahabad to decide the Original Suit No.906 of 2011 (Smt. Shanti Devi Mishra Vs. Jagdish Prasad and 2 others) within stipulated period.
In view of the order proposed to be passed, notices need not go to the private respondents.
It is argued by learned counsel for the petitioner that since the matter is pending consideration before the court below for a long time he is suffering irreparable loss.
With the consent of learned counsel for the present, the present petition is disposed of finally at the admission stage.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the respondent no.1/Judge, Small Causes Court, Allahabad to consider and decide the aforesaid suit in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
