Heard learned counsel for the petitioner and learned counsel for the State.
This petition has been filed with following prayer:
(i) Issue a writ, direction or order in the nature of certiorari quashing the impugned order dated 22/23.11.2019 served to the petitioner on 27.01.2021 personally passed by District Magistrate, Prayagraj forfeiting the amount of Rs. 2,78,300/- deposited as earnest money by the petitioner against the advertisement dated 12.4.2018 issued by the office of the District Magistrate, Allahabad (Mining Section).
(ii) Issue a writ f mandamus directing respondents to refund the amount of Rs. 2,78,300/- deposited as earnest money in pursuance of advertisement dated 12.4.2018 issued by the District Magistrate, Prayagraj in regard to e-tendering of the mining of Gitti/Bolder at Arazi No. 275 (Khand No. DH-14), situated in Villages Dharawal, Tehsil-Meja, District Prayagraj having 1.012 hectares."
The petition is disposed of in terms of order passed in Writ-C No. 16878 of 2020.
The State has no objection.
