1. This applicant has complained non-compliance of the directions issued by this court as regards taking decision on the representation.
2. In response to the notice issued by this Court, initially, present incumbent on the post of Chief Officer Mr. Jayeshkumar B. Soni had remained present and stated reasons for not taking the decision on the representation within the time permitted. It is recorded in the earlier order that if the decision on the representation was not taken, the Chief Officer i.e. respondent No.3 shall remain present. On the next date of hearing, Chief Officer Mr. Jayeshkumar Balmukund Soni had remained present and subsequently he filed affidavit. On pir asking as to who was to take decision at the relevant time, we were apprised that one Mr. N.S. Shaikh who was having the charge at the relevant time was to take the decision. We, therefore, required Shri N.S. Shaikh to file affidavit. Present incumbent Mr. Soni as well as Mr. N.S. Shaikh both have filed affidavit and explained the circumstances under which the representation could not be decided within the time permitted by this court.
3. Having gone through the explanation given by way of affidavit and since the decision is already taken on the representation, we now do not propose to continue these contempt proceedings since the respondent No.3 that is present incumbent Mr. Soni as well as Mr. N.S. Shaikh both have tendered apology and stated reasons for not taking the decision within the time permitted by this Court. We, therefore, close these contempt proceedings. Accordingly, this Miscellaneous Civil Application stands disposed of. Notice stands discharged.
