JUDGMENT / ORDER

By this application, the applicant seeks fixation of an early date of hearing of Second Appeal No.5 of 2005.
Heard Mr.Jagdish Chauhan learned advocate for Mr.Vaibhav A. Vyas, learned advocate for the applicant.
Having regard to the question formulated by this Court while admitting the appeal, the application is allowed. Second Appeal No.5 of 2005 to be listed for hearing on the final hearing board in the week commencing from 13th February 2012.
The application stands disposed of accordingly.
