Heard Sri Ashok Khare, learned Senior Counsel in support of this petition and Sri Nipun Singh, learned counsel who appears for the Commission.
The petitioner seeks issuance of a direction requiring the respondents to permit him to appear for physical verification of her testimonials. It is pertinent to note here that the Commission by its Notification dated 2 July 2020 published a time frame according to which, candidates were required to appear before it for physical verification of their testimonials. It is contended on behalf of the petitioner that no individual notices were issued to the candidates even though their e mail, phone numbers and other particulars were in the possession of the Commission and it is on that account that the petitioner could not appear.
Sri Nipun Singh has placed on the record instructions which for the purposes of identification are marked as "X". From those instructions, it is pointed out that the notice of 2 July 2020 was duly published in newspapers and also placed on the official web portal of the Commission. Sri Singh further points out that earlier also opportunities had been accorded to all candidates including the petitioner here when they were required to appear for physical verification of testimonials on 18 November 2019 and thereafter on 10 July 2020. However, it is pointed out that the petitioner chose not to present himself or avail those opportunities.
The imperatives of a candidate appearing before the Commission for the purposes of physical verification has already been duly noticed and ruled upon by a Full Bench of the Court in Rajendra Patel Vs. State of U.P. and Another, 2015 (8) ADJ 219.
Bearing in mind the aforesaid decision, the Court finds no ground to issue the writs as prayed for.
Petition is consequently dismissed.
