A preliminary objection has been raised by counsel for the plaintiff- respondent that the revisionist has alternative remedy of filing revision under Section 25 of the Provincial Small Causes Court Act against order dated 21.1.2019, impugned herein, whereby, the defence has been struck off.
Counsel for the revisionist is not in a position to dispute the objection raised in this regard. He states that liberty be granted to the petitioner to challenge the impugned order by filing revision.
Accordingly, the petition is disposed of with liberty to the petitioner to challenge the impugned order by filing revision under Section 25 of the Provincial Small Causes Court Act.
Certified copy of the order shall be returned to the learned counsel for the petitioner, after retaining photo copy on record.
