Heard learned counsel for the petitioner and Sri Zafaryab Jilani, Additional Advocate General for the State of U.P.
This petition has been filed by the petitioner Shanker with a prayer that investigation of case crime No. 277 of 2013 under sections 147, 342, 504, 506, 364, 302 IPC, P.S. Ghazipur, District Lucknow may be transferred to some other independent agency preferably to CBCID for making the fair investigation.
From the perusal of the record it reveals that petitioner is first informant of this case, his son has been killed. According to the statement given by the learned Additional Advocate General the investigation of this case is pending, in which nobody could be made accused. The viscera report has been received in which no poison has been found, but according to the statement made by learned counsel for the petitioner there is evidence available but the local police has not collected the evidence. In such circumstances, we feel it proper that investigation of this case may be done by the police officer not below the rank of Deputy S.P. Therefore, S.S.P. Lucknow is hereby directed that investigation of this case be handed over to the police officer not below the rank of Deputy S.P. but the officer may not be circle officer of police station, Ghazipur.
With the above direction, this petition is finally disposed of.
