Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"i) Issue a writ, order or direction in the nature of mandamus directing the respondent no.1 to decide the Appeal No.262/A Computer No.C2011150000475 (Shanker Vs. Shivesh Kumar and another), under Section 331 of U.P.Z.A. and L.R. Act, filed by petitioner, pending before the respondent no.1, expeditiously with stipulated fixed short period, accordance with law."
The petitioner is aggrieved on account of the pendency of his appeal, which is directed against an exparte decree in a suit under Section 229B of the U.P.Zamindari Abolition and Land Reforms Act. The appeal stated to be pending since the year 2011.
Under the circumstances, this writ petition is disposed of with the observation that in case, the lower Court record has been received and the matter is otherwise ripe for hearing and the respondent no.1 shall endeavour to decide the appeal of the petitioner, expeditiously, preferably within a period of four months from the date a certified copy of this order is filed before him.
It is, however, provided that similar matters, which have remained pending for a longer period, must necessarily be afforded preference.
