JUDGMENT / ORDER

Heard the learned counsel for the applicant and the learned A.G.A. This application has been filed by the applicant with a prayer to quash the charge sheet in case crime No. 463 of 2008 under sections 420, 504, 506 I.P.C., Police Station Partapur, District Meerut, pending in the court of learned Special Chief Judicial Magistrate, Meerut in criminal case No. 175 of 2009.
It is contended by the learned counsel for the applicant there was no registered agreement to sale, the allegation made against the applicant is absolutely false and frivolous but without doing proper investigation, the charge sheet has been submitted against the applicant. In reply to the above contention, it is submitted by learned A.G.A. that such pleas may be taken before the court concerned by way of moving discharge application.
Considering the facts, circumstances of the case and submission made by the learned counsel for the applicant and the learned A.G.A. it is directed that in case the applicant moves a discharge application before the court concerned, through his counsel within 30 days from today, the same shall be heard and disposed of expeditiously in accordance with the provisions of law.
Till the disposal of the discharge application, no coercive steps shall be taken against the applicant.
