By means of the present writ petition the petitioner has challenged the order dated 21.8.2019 by which the Appeal No. 00125/2019 filed by the petitioner has been dismissed due to non deposit of the 50% of the disputed amount as per the prescribed mandatory condition.
Learned counsel for the petitioner submits that waiver of the same amount can be granted in favour of the petitioner.
Dr. S.K.Yadav, learned counsel appearing for respondent nos. 3 and 4 submits that the impugned order has been passed in accordance with law as there is a mandatory condition under section 127(2) of the Electricity Act, 2003 that 50% of the disputed amount has to be deposited. Learned counsel for the petitioner could not dispute the said fact.
Accordingly this Court is not inclined to interfere with the order dated 21.8.2019. The writ petition is dismissed.
