Shanker Lal S/O Shri Hari Lal vs State Of U.P.Through ...

High Court Of Judicature at Allahabad|09 January, 2010

JUDGMENT / ORDER

Heard learned Counsel for the petitioner and the learned Standing Counsel.
Counsel for the petitioner submits that inspite of representation and reminders the petitioner, who is working as qualified X-ray Technical at District Jail, Sultanpur is illegally being denied the pay scale of Rs. 1350-2200 w.e.f. 1.1.1986 [ instead of Rs. 1200-2040), arrears of selection grade w.e.f. 17.11.1993 to 16.11.1995 in the scale of Rs. 1400-2300 though the similarly situated X-ray Technician working in the Department of Prison as well as Department of Health and Family Welfare are getting the benefit of the aforesaid scales. Counsel for the petitioner submits that there is no difference between the nature of work, qualification etc of the petitioner as compared to those of the X-ray Technicians of the Department of Prison and Health.
During the course of arguments learned Counsel for the petitioner submitted that the interest of justice would suffice, if the opposite parties are directed to pass appropriate orders on the representation of the petitioner contained in Annexure-18 to the writ petition. Standing Counsel has no objection to this prayer.
Accordingly, Inspector General ( Prison) U.P. Lucknow, ( opposite party no.3) is directed to pass appropriate reasoned and speaking order on the representation of the petitioner within a period of two months from the date of production of certified copy of this order.
With the aforesaid observations and directions this writ petition is disposed of finally.
