The present civil application has been filed for condonation of delay of 799 days caused in filing the First Appeal under Section 5 of the Limitation Act on the grounds stated in the application that they were not aware about the fact that the respondent no.5 has expired.

Heard learned counsel appearing for the respective parties.

It is in these circumstances, with the consent of the parties, the present application deserves to be allowed.

The delay is condoned. The application stands disposed of as allowed. Rule is made absolute.
