1.0 By way of present petition, the petitioner has challenged order dated 20.01.2012 passed by the Gujarat Co-operative Tribunal in Revision Application No. 122 of 2011 whereby the order passed by the learned Board of Nominees Court, below Exh. 6 in Lavad Suit No. 230 of 2012 is set aside by confirming the action of the respondent No.1 giving permission to run a milk collection centre to respondent No.2.
2.0 Learned advocate for the petitioner contended that the Janvad is an adjoining street of village Gotarka and only 500 meters away from the mandli of the petitioner is situated. The report submitted by the respondent No.3 informed the respondent No.1 that the proposed milk Collection centre is away from 2 kms from the petitioner Mandli. The revisional authority by considering the report of the respondent No.3 set aside the order passed by the learned Board of Nominees Court below Exh. 6 in Lavad Suit No. 230 of 2010.
3.0 This Court on 02.02.2012 passed order which reads as under:
"Only for the limited purpose of imposing some conditions while allowing the revision application, NOTICE returnable on 29.02.2012. Direct service permitted."
4.0 In view of that matter, following condition is imposed.
New centre of milk collection shall not collect milk from the members who are giving milk to the first milk collection centre run by the petitioner-society.
5.0 With the above direction, the petition stands disposed of. Notice is discharged.
