THE HON’BLE SRI JUSTICE S. RAVI KUMAR CRIMINAL PETITION No. 1728 of 2012 ORDER:
This criminal petition is filed to quash crime No.4 of 2012 of Panjagutta Police Station for the alleged offences under Sections 506, 509, 448 and 354 of IPC.
2. Heard both sides.
3. Advocate for petitioners submitted that because of the property dispute, all the family members are implicated and that there was no incident as alleged in the complaint. He submitted that defacto- complainant-2nd respondent is sister-in-law of the petitioners i.e., wife of their brother. He submitted that because of the property disputes between the brothers, the complaint was pressed into service through defacto-complainant.
4. Learned Public Prosecutor submitted that he has not received any instructions from the police.
5. I have perused the material papers filed along with quash petition including complaint just filed before the XIV Additional Chief Metropolitan Magistrate, Hyderabad under Section 200 Cr.P.C. which was forwarded to police for investigation under Section 156(3) Cr.P.C.
6. Considering the nature of allegations and the relationship between the parties, I feel it appropriate to dispose of this petition by directing the police to expedite the investigation by not arresting the petitioners till completion of the investigation.
7. Accordingly, the Criminal Petition is disposed of directing the police to expedite the investigation. In the meanwhile, police are directed not to arrest the petitioners till completion of investigation or filing of final report, whichever is earlier.
As a sequel, miscellaneous petitions, if any filed in this criminal petition, shall stand closed.
