A suit was filed by the respondent no. 9 seeking injunction against the petitioner in respect of the disputed property. The trial court vide order dated 26.07.2012 passed temporary injunction order restraining the petitioner-defendant from interfering with the peaceful possession of respondent no. 9 over the suit property.
Grievance of the petitioner is that on an application made by the respondent no. 9, the respondent no. 4-Tehsildar Lalganj, Azamgarh in the garb of compliance of the temporary injunction order has demolished the property of the petitioner which was subject matter of suit.
It is a disputed question of fact.
In the circumstances, it would be appropriate that if the petitioner approaches the Civil Court itself where the suit is pending, raising his grievances by making a proper application and in case any such application is made, the court concerned shall proceed to consider and decide the same in accordance with law.
With the aforesaid direction, writ petition stands disposed of.
