It is stated that without disclosing any reason, order of regularization of services of the has been kept in abeyance. This order has been passed on 5.2.2018. Grievance is that even after expiry of nearly 8 months, the authorities have not taken final decision and the benefit of regularization has been denied to him.
Learned counsel for the petitioner submits that the petitioner was entitled to regularization under the rules and, therefore, no reason or justification exists for suspending the order of regularisation.
Learned Standing Counsel states that such issues can be examined by the authority concerned, in accordance with law, at the first instance.
Considering the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon the respondent no.4 to accord consideration to the petitioner's claim and to take a final decision in the matter within a period of three months from the date of presentation of certified copy of this order. Needless to say that in case order of regularization suffers from any illegality, the petitioner would be intimated of such reasons and he would be heard before taking a final decision.
